Microsoft's LinkedIn overruled in public profile data stoush

A United States federal judge has ruled that Microsoft can not block a startup from accessing data held on its LinkedIn platform, a decision that is likely to have further implications for social media companies wishing to control data that is considered publicly available.

hiQ took LinkedIn to court, and US District Judge Edward Chen has ruled in its favour.

In granting our request for a preliminary injunction against LinkedIn, Judge Chen rejected LinkedIn's attempt to cast hiQ's aggregation and analysis of publicly available information from the LinkedIn website as a violation of a federal criminal statute.

HiQ Labs is developing a platform that will "scrape" data from LinkedIn to identify employee behaviours, such as when they are likely to jump ship or start looking about, reports Reuters. The judge raised concerns around LinkedIn "unfairly leveraging its power in the professional networking market for an anticompetitive objective", and compared LinkedIn's argument to allowing website owners to "block access by individuals or groups on the basis of race or gender discrimination".

The battle between the two employment companies has been playing out since LinkedIn sent hiQ a cease-and-desist letter in May accusing the startup of violating its terms of service by data scrapping.

"It is important to understand that hiQ doesn't analyze private sections of LinkedIn - we only review public profile information".

"This is a case with broad ramifications for free speech, competitiveness, and the fair use of material available to all on the internet", Mark Weidick, CEO at HiQ Labs, said in a statement in July. We don't republish or sell the data we collect.

"We're disappointed in the court's ruling", Leverich said.

HiQ which filed an anti-trust suit in June, had said: "HiQ believes that public data must remain public, and innovation on the internet should not be stifled by legal bullying or the anti-competitive hoarding of public data by a small group of powerful companies".

The hiQ and LinkedIn case became an industry hot button as hiQ alleged the professional social network of engaging in antitrust behavior and for a recently Microsoft owned property, that's a bad look.
