US judge: Facebook must face class action over facial recognition
Judge James Donato ruled the claims by IL residents Nimesh Patel, Adam Pezen, and Carlo Licata were "sufficiently cohesive to allow for a fair and efficient resolution on a class basis". The company issued a statement through a spokesman saying that the case had no merit, and would fight it vigorously.
The ruling on Monday by a U.S. federal judge in California comes as the social network is snared in a scandal over the mishandling of 87 million users' data ahead of the 2016 U.S. presidential election. The lawsuit says this breaches IL state law.
The new login system will launch on Tuesday, April 17, and will enable users to register and log into the dating app without having to share any data with Facebook.
Facebook's arguments that no "actual" harm was caused and that the Act can't apply because its servers aren't in IL failed to convince Donato. CEO Mark Zuckerberg insisted during his hearing before Congress that "On Facebook, you have control over your information... the information we collect you can choose to have us not collect, ' but how can users prevent other companies from collecting their data?" The certification of a class of users is a key step in brining a class action.
Facebook tried to dismiss this lawsuit as well, arguing that users who sued "know nearly nothing" about the platform's facial recognition tech.

Jennifer Lynch, senior staff attorney at the Electronic Frontier Foundation, warned that if this facial recognition database had been shared with the US government, it could pose a significant threat to free speech.
The feature suggests who might be present in uploaded photos, based on an existing database of faces. It's not alone - Google is facing a similar class action in Chicago centred on its Google Photos service.
"If you've never been tagged in a photo on Facebook or have untagged yourself in all photos of you on Facebook, then we do not have this summary information for you", the company says.
The facial recognition feature isn't now available in the UK. It's a hot-button issue, as sweeping new European Union privacy legislation requires Facebook and other tech companies to get explicit permission for using the technology.
