Federal Appeals Court Will Soon Rule On Decision To End DACA

SAN FRANCISCO Federal appeals court judges appeared skeptical Tuesday of the Trump administration's claim that courts don't have the power to review the president's decision to end a program that shields young immigrants from deportation. MORE: DACA supporters block intersection in downtown Los Angeles during rally However, the 9th Circuit is widely considered the most liberal of the USA appeals courts, making a Trump administration win unlikely.

The Senate confirmed two more of President Trump's appeals court nominees Tuesday, bringing his total to 21 circuit judges placed on the bench in his 16 months in office.

DACA supporters rallied outside of a Southern California federal courthouse while inside arguments were heard which will impact their future. He said the Trump administration sought to reset enforcement priorities in phasing out the program and has broad discretion to do so. White House attorneys are now challenging that decision.

Last fall the challengers won the first round when Judge William Alsup, of the United States District Court for the Northern District of California, issued a preliminary nationwide injunction and ordered that renewals under the program continue.

The judges on Tuesday seemed concerned about how the Trump administration made a decision to unwind the DACA program, whether the move had violated the equal protection rights of the recipients and if the court should take presidential tweets and statements in consideration as they considered the case.

The Trump administration wants the former ruling thrown out.

Judge Jacqueline Nguyen questioned whether courts could intervene if they thought DACA was legal and disagreed with the administration's position that it was unconstitutional.

U.S. District Judge Carlton Reeves ruled in January 2017 that the federal court lacks jurisdiction to decide the outcome of the state House race.

Michael Mongan, the deputy solicitor general of California said the administration hadn't shown "its homework" and it was necessary to do so before terminating the program.

"When we say that sometimes our colleagues and this president are divisive, it's actions like this that document that, and make the fact that they are being divisive irrefutable", he said.

"They haven't done that here".

Federal judges in NY and Washington, D.C., also have ruled against Trump on DACA. Three appellate court judges heard arguments from the Department of Homeland Security and the state of California including the UC system.
