Bethesda Sues Warner Bros. For ‘Blatant’ Fallout Shelter Rip-Off

However, it looks like the app's time may be shortlived as Bethesda is suing Warner Bros. and Canadian game developer Behaviour Interactive for allegedly using code from Bethesday's Fallout Shelter mobile game.

The suit goes on to allege that well after the release of Fallout Shelter, Warner Bros. made a decision to collaborate with Behaviour to develop a mobile game of its own based on Westworld.

"The identical problem appeared in initial versions of Fallout Shelter but was addressed before Fallout Shelter was released to the public", the lawsuit states. The main link between the evidence is that Behaviour Interactive was contracted by Bethesda during Fallout Shelter's development, prior to their work on the Westworld title for Warner Bros., which would (seemingly) explain their access to code used in Fallout Shelter.

The game earned over $5.1 million Dollars within the first two weeks of its release.

Bethesda Softworks has filed a lawsuit against developer Behaviour Interactive and publisher Warner Bros. The case arises from Behaviour's development of a "Westworld" mobile game for Warner Bros.

Polygon reported on the suit, which was filed in a Maryland US District Court. Fallout Shelter is a management simulator in which you create different rooms for your vault, and try to keep your residents happy by matching them up with jobs they would like doing best.

Fallout Shelter is a free-to-play mobile game that was developed by Bethesda Game Studios and Behaviour Interactive.

Bethesda says Behaviour and Warner Bros. used its intellectual property without authorization. "As a result of Behaviour and Warner Bros" unlawful conduct, "Westworld" is a blatant ripoff of "Fallout Shelter" with largely superficial, cosmetic changes. Released this week and based on the TV show of the same name, "Westworld" is a "training simulator" where players must build underground maintenance and control facilities for the theme park. "It is as if a camera capturing the scene had been inadvertently pointed to the lower right foreground and then slowly refocuses on the central image".

Bethesda is asking for damages and all versions of the Westworld game to be removed.
