The suit goes on to allege that well after the release of FalloutShelter, Warner Bros. made a decision to collaborate with Behaviour to develop a mobile game of its own based on Westworld.
"The identical problem appeared in initial versions of FalloutShelter but was addressed before FalloutShelter was released to the public", the lawsuit states. The main link between the evidence is that Behaviour Interactive was contracted by Bethesda during Fallout Shelter's development, prior to their work on the Westworld title for Warner Bros., which would (seemingly) explain their access to code used in FalloutShelter.
The game earned over $5.1 million Dollars within the first two weeks of its release.
