Compensation sought for Australians caught up in Facebook privacy breach

Not just another Facebook data scandal

Elizabeth Denham, the Information Commissioner, wrote in her accompanying report that Facebook should have done more to explain to its users why they were targeted for specific political advertisements or messaging.

The scandal took place before new European Union data protection laws that allow much larger fines came into force.

IMF Bentham said it had partnered with law firm Johnson Winter & Slattery to lodge the complaint with the Office of the Australian Information Commissioner.

The UK Information Commissioner's Office is threatening the company with the maximum penalty allowed, it said on Wednesday when issuing its first findings in a probe that looked at some 30 organisations, including social-media platforms such as Facebook.

"We are fully cooperating with the investigation now under way by the Australian Privacy Commissioner and will review any additional evidence that is made available when the UK Office of the Information Commissioner releases their report", the spokeswoman said. "Whilst these concerns about Facebook's advertising model exist generally in relation to its commercial use, they are heightened when these tools are used for political campaigning".

Facebook, along with consultancy Cambridge Analytica, has been the focus of the investigation since February when evidence emerged that an app was used to harvest the data of 50 million Facebook users across the world.

United Kingdom investigators also questioned whether Facebook failed to maintain adequate safeguards to ensure other third-party app developers had not misused social data.

The world's largest social network said in April that data of up to 87 million people ended up in the hands of Cambridge Analytica, which was employed by Donald Trump's 2016 US presidential campaign. British authorities also said Tuesday they are bringing a "criminal prosecution" against the parent company for SCL Elections Limited, for failing to respond to its enforcement notices.

Facebook has faced widespread criticism from users and scrutiny around the world from regulators and lawmakers since news broke that users' data had been shared.

It's not the first time, however, that Europe has penalized Facebook.
