Disgraced mogul Harvey Weinstein wants a judge to toss a lawsuit accusing him of destroying Ashley Judd's career because she rebuffed his sexual advances, claiming he never defamed the star - but simply offered his opinion that she was very hard to work with.

The attorneys make other arguments as well, that Judd failed to demonstrate that the purported harassment was anything but an isolated incident, claiming that the two had struck "a bargain" with respect to future sexual activity.

Judd has said she only became aware of Weinstein's actions after Jackson gave an interview in December, in which he claimed that Miramax had engaged in a "smear campaign" against Judd and actress Mira Sorvino.

"Mr Weinstein's arguments seeking to escape the consequences of his despicable misconduct are not only baseless, they are offensive".

Judd sued Weinstein in April, saying he effectively blackballed her in Hollywood and sabotaged her getting a significant role in the Lord of the Rings trilogy in 1998. She alleges that Weinstein was retaliating for her rebuff during a meeting at the Peninsula Hotel in Beverly Hills.

"Weinstein's alleged unwanted sexual advances occurred on a single day and consisted of him asking to give Plaintiff a massage, asking her to help him pick out clothes, and asking her to watch him shower", the attorneys write.

The court documents filed overnight discuss Judd's comment that she would only let Weinstein touch her after she won an Academy Award in one of his films. Judd was one of the actresses who went on the record for a New York Times expose of Weinstein's behaviour a year ago.

But Weinstein's lawyers claim the deal was real.

His attorneys argue that his subsequent efforts to "live up to the bargain" by trying to cast her in Oscar-worthy roles prove he wasn't trying to ruin her career.

The lawyers also said the statute of limitations has expired on Judd's allegations that Weinstein did her financial damage. An avalanche of sexual misconduct complaints followed against a number of men across a variety of industries.

"Weinstein torpedoed Ms. Judd's incredible professional opportunity when he told (director Peter) Jackson and (production partner Fran) Walsh that the studio had had a "bad experience" with Ms. Judd and that Ms. Judd was a "nightmare" to work with and should be avoided 'at all costs, '" Judd's suit charges.

Weinstein's lawyers say it meant Judd acknowledged that Weinstein would try to get her movie roles.
