FDA Plans To Impose Severe Restrictions On E-Cigarettes

The ban means only tobacco mint and menthol flavors can be sold in convenience stores and gas stations

The Food and Drug Administration is also looking to create strict limits on the sale of most flavored e-cigarettes across the country. Gottlieb is also expected to propose banning menthol in regular cigarettes, which is sure to get pushback from the tobacco industry.

"As the governor previously said, he's very concerned about the rise in youth e-cigarette use and this administration is looking to do everything it can to curb this emerging public health issue", Richard Azzopardi, a spokesman for Democratic Gov. Andrew Cuomo, said in an email.

"We now have evidence that a new generation is being addicted to nicotine, and we can't tolerate that", he said, referring to the vaping data in an interview before he made final decisions on e-cigarette policy.

The FDA announced in September it would investigate major e-cigarette makers Juul, MarkTen, Vuse, Blu and Logic, including reviews of marketing and sales practices.

The only exception to the flavored products ban in convenience stores involves menthol e-cigarette products.

"E-cigs have become an nearly ubiquitous - and unsafe - trend among teens", FDA Commissioner Scott Gottlieb said in September. But the products would be available in vape and tobacco shops.

There has been mounting pressure for action after preliminary federal data showed teenage use had surged by more than 75 percent since a year ago, and the FDA has described it as an "epidemic".
