Snowball fights now legal in Colorado town after boy's quest

A 9-year-old boy has convinced the leaders of Severance, Colorado to overturn a almost century-old ban on snowball fights - leaving his little brother to be quick on his toes as the first legal target.

Best chose to challenge the town board after learning several weeks ago that it was illegal to throw a snowball in the town that is home to almost 5,000, the Greeley Tribune reported.

Dane Best, who lives in the often snow-swept town just north of Windsor, presented his arguments at a town board meeting Monday night.

'I think it's an outdated law, ' Dane said. "Because his grandpa couldn't".

The rule was part of an old ordinance outlawing the throwing of missiles, such as stones, at property or people within the town. "Little kids should be allowed to throw snowballs at each other".

Best also provided the board with letters written by his classmates who supported his motion to repeal the law.

"I asked my mom if I could (ask council to change the law), and she called town hall".

Kyle Rietkerk, assistant to the Severance town administrator, told the newspaper kids visiting Severance Town Hall on school field trips were always shocked to learn that it is illegal to throw a snowball.

The ordinance has been in the town's books since its founding in 1920 when snowballs were considered "missiles" like rocks. "Today's kids need a reason to play outside", he added in his three-minute presentation, the Greeley Tribune reported.

Speaking in front of a crowd of residents and media, Best told town trustees that because of the almost 100-year-old ban, which classified snowballs as a type of missile, he couldn't throw a snowball without worrying about breaking the law, or getting into trouble.

"Following that he received a little plaque and a gift card that had to be used to buy a snowball maker", Rietkerk said.

And Dane was ready for the board members' tough questions.

Before Monday night, a town law prohibited throwing snowballs, as Mayor Don McLeod pointed out to CBS4's Dillon Thomas.

Dane's family said they are proud to see their son take the initiative to make a change.

'He's always been timid and bashful, so when he told me he was doing that, I said, "Good for you Daners,"' said his grandfather Rick Best. The second throw went to Best's younger brother Dax - whom Dane has identified as his preferred opponent.

"He has a pet guinea pig and he keeps telling us he's breaking the law by having it", Brooke Best said.
