Choose Your Own Adventure Book Publisher is Suing Netflix Over BANDERSNATCH

Stuart Hendry Netflix

Let's just get this out of the way: I hated Netflix's Black Mirror movie, Bandersnatch. It was Chooseco who initially published the "Choose Your Own Adventure" books in the '80s and '90s that young readers loved so much.

Black Mirror: Bandersnatch is on the receiving end of a lawsuit from the owners of "Choose Your Own Adventure" books.

Moreover, Chooseco's filing revealed that as far back as 2016, Netflix had entered into discussions with the publisher over the possibility of obtaining a license that would have put them legally in the clear to use the "Choose Your Own Adventure" brand as a plot hook.

Netflix is heading down a litigious path over Black Mirror: Bandersnatch.

The lawsuit also claims the trademarked terminology has been used in marketing efforts for Bandersnatch, which serves as a benefit to Netflix without permission. "The misappropriation of the trademark without permission puts Chooseco in a hard situation as the graphic and offensive nature of the content is particularly damaging for fans of the series young and old, and tarnishes the mark".

Netflix sued over Bandersnatch's similarities to Choose Your Own Adventure

Bandersnatch, which aired on December 28, prompts viewers to make quick decisions for protagonist Stefan Butler, allowing them to determine the narrative.

The book publisher is Vermont-based Chooseco LLC and alleges in the suit that Netflix basically exploited the brand associated with the book company's famous property to market the film. Additionally, the suit suggests that 20th Century Fox has optioned the rights to develop films based on these books.

"Chooseco and Netflix engaged in extensive negotiations that were ongoing for a number of years, but Netflix did not receive a license", states the complaint, per THR.

Netflix has no comment on the matter. The popular book series sent children on many fantastical adventures, like time travel through space or in search of the abominable snowman.

Chooseco are seeking at least $25 million (£19.4 million) or Netflix's profits from the film, depending which is the greater amount.
