Chicago sues Jussie Smollett for refusing to reimburse city

More than two dozen officers and detectives spent two weeks investigating Smollett's claims, with the police department forced to pay for 1,836 overtime hours, the filing says. But the City of Chicago and its police department maintain that he did and in the complaint, the city is asking for a jury trial "to recover civil penalties, statutory treble damages, and attorney's fees and costs arising from the Defendant's false statements to the City".

Mayor Rahm Emanuel denounced the decision as "a whitewash of justice", and others criticized the Cook County state's attorney's office for not requiring an apology and an admission of guilt from Smollett as a condition for tossing the case.

The suit comes after Smollett refused a demand that he send the city $130,106 to reimburse Chicago for overtime as police sought to verify Smollett's account.

The "Empire" actor has been accused of orchestrating the January 29 assault, during which he claims two men yelled racial and homophobic slurs while beating him, pouring an unknown chemical substance on him and wrapping a rope around his neck.

The actor has insisted he told the truth about the attack. Attorneys for Smollett did not immediately respond to Fox News' request for comment.

"Your letter is both factually and legally flawed, and Mr. Smollett will not be intimidated into paying the demanded sum", a statement signed by Mark Geragos, of the Geragos and Geragos law firm, said. He said his attackers also yelled, "This is MAGA country", a reference to President Donald Trump's campaign slogan, "Make America Great Again".

The "Empire" star, 36, claimed his assailants doused him with bleach, threw a noose around his neck and beat him.

Smollett voluntarily forfeited his $10,000 bond, and Smollett's attorney, Patricia Brown-Holmes, said the funds would likely go to Chicago.

In the lawsuit, the City alleges that Jussie has been friends with one of his alleged attackers, Abel Osundairo, since 2017, and claims he contacted Abel shortly before the attack to ask him for "help on the low".

Police ultimately came to believe Smollett staged the attack to bolster his profile and career, but all 16 felony disorderly conduct charges against the "Empire" actor were dropped last month.

It's also unclear if Mayor-elect Lori Lightfoot is onboard with the Emanuel administration's determination to keep legal pressure on Smollett.
