Judge says video of Robert Kraft’s allegedly illicit massage parlor encounter can’t be used as evidence

New England Patriots owner Robert Kraft scored a major victory in his solicitation of prositution case on Monday, as a judge ruled that the video of him allegedly receiving illegal sex acts inside a day spa in Florida can not be used as evidence in the trial.

Palm Beach County Judge Leonard Hasner ruled to suppress all evidence obtained through a search warrant to take part in surveillance at the Orchids of Asia Day Spa in Jupiter, Fla., stating police failed to meet the guidelines of the warrant.

He and other defendants pleaded not guilty to misdemeanor charges stemming from the footage and other surveillance methods.

"Now that the Court has concluded that the Videoes were illegally obtained and subject to suppression, it follows that the public has no right to access these materials - which materials never should never come into existence in the first place, " Kraft's lawyers wrote.

Prosecutors were hoping to use the video to win a conviction against Kraft and at least and 25 other men, whom they have charged with solicitation.

Kraft was one of nearly 300 men who were charged in February with paying for sex acts following police busts at 10 massage parlors that stretched from the Palm Beach area to Orlando.

Kraft's attorneys are expected to file a motion to dismiss the case based on a lack of evidence, ESPN's T.J. Quinn reports.

National Football League officials have said they are watching the case, but have not disciplined Kraft.

He was alleged to have visited a location in Jupiter and allegedly paid for a sex act in mid-January, then returned the next morning for the same reason before flying to Kansas City to watch his team play in the AFC championship game.

Hanser has ordered Kraft to appear in court for a May 21 pretrial hearing.
