Appeals court dismisses Trump emoluments case

After a federal court ruled Donald Trump could not constitutionally block people on Twitter Democratic congresswoman Alexandria Ocasio Cortez was threatened with a lawsuit for allegedly doing the

Many Democrats and other critics claim that President Trump's business interests could lead to violations of the emoluments clause, which forbids USA presidents from accepting gifts from foreign governments and individuals. This particular lawsuit was brought by both the District of Columbia and Maryland. Trump tweeted that he doesn't make money but loses "a fortune" by serving as president.

Trump quickly celebrated Wednesday's ruling and appeared to embrace the court's suggestion that the presidency could hurt Trump's businesses.

District of Columbia Attorney General Karl Racine has previously said that if the panel ruled against Maryland and the District, the legal team would seriously consider asking for a rehearing before the full 4th Circuit.

A spokesperson for the Department of Justice, which is representing Trump in multiple emoluments lawsuits, said in a written statement to Newsweek that it is "pleased that the Fourth Circuit unanimously made a decision to dismiss this extraordinarily flawed case".

The Trump International Hotel is located on Pennsylvania Avenue, just four streets from the White House. On Wednesday, the Fourth Circuit Court of Appeals ordered the dismissal of the lawsuit, stating they did not have the standing to sue the president.

"Today's pair of decisions by the 4th Circuit Court of Appeals is a complete victory", Trump's personal attorney, Jay Sekulow, said in a statement.

The New York-based 2nd U.S. Circuit Court of Appeals ruled Mr Trump's Twitter account is a public forum, and blocking users based on viewpoint violates America's First Amendment, which guarantees freedom of speech.

Frosh and Racine said in a joint statement Wednesday that the appeals court "got it wrong".

Starbucks Debuts Tie-Dye Frappuccino and Here's How to Order It Vegan
Made with whole milk and topped with whipped cream, the crème-based beverage has tropical fruit flavors and zero caffeine. What's the flavor you ask? The frappuccino is only available for a limited time in stores nationwide starting Wednesday.

"We are pleased that the Fourth Circuit unanimously chose to dismiss this extraordinarily flawed case", Justice Department spokesperson Kelly Laco said in a statement. In addition, an injunction against the president himself is hardly eyebrow-raising when he is the sole individual in the world whose actions are covered by the Domestic Emoluments Clause.

The companion opinions in In re Donald J. Trump and District of Columbia and Maryland v. Donald J. Trump were authored by Judge Paul Niemeyer and joined by Judges Dennis Shedd and Marvin Quattlebaum.

They noted that Trump had used Twitter to announce his nomination of an Federal Bureau of Investigation director, to announce a ban on transgender individuals serving in the military, to announce the firing of his chief of staff, and about his decision to sell sophisticated military hardware to Japan and South Korea.

"Even if government officials were patronizing the hotel to curry the president's favor, there is no reason to conclude that they would cease doing so were the president enjoined from receiving income from the hotel".

We have not and will not abandon our efforts to hold President Trump accountable for violating the Nation's original anti-corruption laws.

The panel of three judges decided that D.C. and Maryland "lack standing" to continue with their case.

Prior to Trump's election to office, no US court has ever ruled on the emolument clauses, nor outlined how they might be enforced; a lack of precedent that was also noted by the appellate judges.

Trump has been a social media pioneer among politicians, earning daily headlines from tweets.
