Trump officials tell one court Obamacare is failing and another it’s thriving

The traditionally Republican states will ask a panel of federal judges in New Orleans to repeal the ACA, seven months after U.S. District Judge Reed O'Connor ruled former President Barack Obama's signature healthcare law is unconstitutional.

A three-judge panel of the 5th US Circuit Court of Appeals in New Orleans, Louisiana, including two judges appointed by Republican presidents and one by a Democrat, will take up a ruling by a federal judge in Texas previous year that said the entire ACA was unconstitutional.

"The Affordable Care Act's individual mandate was a bad policy experiment that fell short of its goals", Duffy said in a statement to NewsChannel 7 on Tuesday.

The panel is considering an appeal from Democrats, who say a judge in Texas erred by ruling the mandate is unconstitutional and can not be severed from the rest of the law - including its protections for people with preexisting conditions, subsidies for private insurance and expansion of Medicaid.

O'Connor's ruling is on hold, pending appeals.

This year, the Legislature did nothing to expand health coverage under existing law or propose alternatives to Obamacare, Pogue said.

A coalition of Republican-led states headed by Texas sued, alleging the tax penalty's elimination rendered Obamacare unconstitutional. Protections for people with pre-existing conditions like cancer and diabetes.

The case is Texas v. U.S., 19-10011, U.S. Court of Appeals, Fifth Circuit.

The Democratic-led House of Representatives has also been granted intervenor status in the case.

But he wanted to make clear one point: "There is not a single Republican senator who believes people with chronic and/or expensive pre-existing conditions shouldn't have access to quality, affordable health care", Toomey said.

The ultimate outcome of the lawsuit will affect millions of Americans, and the repeal of the nine-year-old law could leave up to 32 million people without health insurance by 2026, according to a Congressional Budget Office report from 2017 about the effects of repealing the ACA.

The Affordable Care Act's broad impact on the health care system is central to the arguments of both sides - with Texas saying that the passage of the law has forced it to spend more money, and California charging that its nullification would cost it money.

"Legally it might be appealed to the Supreme Court which may or may not take it up". But in February, Gov. Gary Herbert signed a replacement to limit Medicaid expansion.

In a brief filed in June 2018, the Trump Administration declared that it would not defend the ACA against the challenge by the Republican Attorneys General. On appeal, the Justice Department changed course and decided the entire ACA should be invalidated. In an unprecedented move, the Trump administration refused to defend the ACA in court, despite it being the law of the land, and instead formally requested the court to strike down the entire health care law, which would jeopardize coverage for 21 million people and eliminate protections for the 133 million Americans with pre-existing conditions, including roughly 860,000 New Mexicans.

But other elements of the ACA have recently been protected in ME, she says.

Judge Jennifer Elrod, appointed by President George W. Bush, asked if lawmakers meant to knock down the law when they ended the penalty for not having coverage as part of the 2017 tax overhaul. Also at risk are billions of dollars in federal assistance that have helped millions of Americans get health insurance through Medicaid and state insurance markets.

Insurance companies will no longer be required to cover essential health benefits, such as prescription drugs, hospitalization, and maternity and newborn care.
